Abstract
This article is the second in a series that looks at FOIA and how it affects government contractors. This article specifically addresses the topic of confidential information and FOIA. FOIA actually exempts trade secrets, privileged, and confidential information from disclosure. 5 U.S.C. § 552(b)(4) exempts from disclosure "trade secrets and commercial or financial information obtained from a person and privileged or confidential. “ Each of the three categories: trade secrets, confidential information and privileged information is treated differently under the law.
